1. Acceptance

By accessing OGs.monster ("the Site"), you agree to these Terms of Use. If you do not agree, do not use the Site.

2. Publisher

The Site is an independent editorial archive published by PromptFluid, a product line created by Kenneth E. Sweet Jr., and held under the KESJR Collective Domains group.

3. Editorial nature

The Site contains research, curation, commentary, opinion, and editorial interpretation about software products from the consumer internet era of roughly 1995–2008. Nothing on the Site constitutes legal, financial, regulatory, compliance, medical, investment, or professional advice. You are responsible for any decisions you make based on information found here.

4. No affiliation

The Site is independent. It is not affiliated with, endorsed by, sponsored by, or officially connected to Napster, Kazaa, Winamp, AOL, BitTorrent, LimeWire, Morpheus, GameSpy, RealPlayer, QuickTime, DivX, Xvid, PowerDVD, WinRAR, Nero, their parent companies, successors-in-interest, or any other third-party brand, agency, publisher, platform, or organization referenced on the Site, unless explicitly stated otherwise.

5. Third-party names and marks

Third-party names, brands, trademarks, logos, products, and company references are used on the Site only for identification, commentary, criticism, research, historical context, market analysis, and source attribution — i.e. nominative and editorial use. The Site makes no claim of ownership over any third-party trademark, logo, or copyrighted work, and all such marks remain the property of their respective owners.

6. Intellectual property

The Site's original writing, structure, taxonomies, naming architecture, research presentation, brand system, visual identity, page layouts, database/tracker organization, machine-readable files (including llms.txt, sitemap.xml, and metadata schemas), prompts, specifications, and editorial synthesis are owned by PromptFluid / Kenneth E. Sweet Jr. unless otherwise stated.

7. Limited license

You are granted a limited, revocable, non-exclusive, non-transferable license to view the Site for personal, research, and educational purposes. All other rights are reserved.

8. Restrictions

You may not, without prior written permission:

• copy, clone, scrape, mirror, repackage, or republish the Site's original content;
• present the Site's editorial writing, taxonomy, or structure as your own work;
• train commercial machine-learning models on the Site's content without an explicit license;
• misrepresent the Site as official, sponsored, or affiliated with any third party;
• use the Site to distribute, link to, or facilitate unlawful copies of copyrighted software.

9. Guestbook submissions

By submitting a guestbook entry you (a) confirm the content is your own or properly licensed, (b) grant the Site a non-exclusive, royalty-free license to display the entry as part of the public guestbook, and (c) accept that we may remove entries at our discretion, including for spam, abuse, hateful content, illegal content, or impersonation.

10. External links

The Site links to third-party sources (Wikipedia, news outlets, the Internet Archive, court documents). We do not control and are not responsible for the content, accuracy, or availability of those sites.

11. Availability and changes

The Site is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue all or part of the Site at any time without notice.

12. Limitation of liability

To the maximum extent permitted by law, PromptFluid, Kenneth E. Sweet Jr., and the KESJR Collective shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including loss of profits, data, or goodwill.

13. Indemnity

You agree to indemnify and hold harmless the publisher and creator from any claims arising out of your misuse of the Site, your violation of these Terms, or your infringement of any third-party right.

14. Governing law

These Terms are governed by the laws of the United States and the State of residence of the publisher, without regard to conflict-of-laws principles. This clause is a reasonable default and may be updated as the publisher's jurisdiction is formalized.

15. Changes to these Terms

We may revise these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Site after changes constitutes acceptance of the revised Terms.
